Try Hello Smile is an online store that operates in accordance with the applicable laws and regulations in the Republic of Serbia as well as in the Republic of Croatia as an EU member.

The services of the Try Hello Smile Shop are available on the website tryhellosmile.com, hereinafter referred to as Try Hello Smile Shop. The pages of the Try Hello Smile Shop can be used for your private use without any usage fees, according to the terms and conditions listed below.

By using the Try Hello Smile Shop, you agree to comply with the terms and conditions listed below and confirm your agreement with them.

The supplier of the ordered goods is “SMILEON TEETH” DOO (hereinafter: “SMILEON TEETH” DOO) and “Hello Smile DOO” for trade and services (hereinafter: "Hello Smile DOO"), utilizing a network of courier services.

A buyer is considered any person who registers and electronically orders at least one product, fills in the required information, and thus completes an online purchase. All prices are expressed in euros, including VAT, and are for informational purposes only.

Ordering goods

Products are ordered electronically. To start shopping, you need to click the "add to cart" button next to the desired product. The selected product will be added to the shopping cart.

To view the currently selected items that you wish to purchase, click on the Cart option in the menu. When you are on this page, you can delete an item that you do not want to purchase or change the desired quantity.

When you want to complete the purchase, click on the "order" option in the menu. A page will open where you need to enter your contact details for the delivery of the desired items.

If you have confirmed that the desired products are in your cart, you need to select the "Proceed to delivery" option to choose the payment method. The next step is to click the "Proceed to payment" button to choose the payment method that suits you best. After confirming the order, it will be recorded, and you will receive an email notification of receipt.

Payment

Payment by credit cards is made by proceeding to our payment processor's webpage, Banca Intesa, after the "checkout" page.

Protection of Confidential Transaction Data

When entering credit card information, confidential information is transmitted through the public network in a protected (encrypted) form using SSL protocols and PKI systems, the most advanced cryptographic technology available.

The security of transaction data during purchase is guaranteed by the card payment processor, Banca Intesa ad Beograd, and the entire payment process takes place on the bank's pages. At no point are full card details available to our system.

Currency Conversion during Payment

All payments by credit cards will be made in the buyer's local currency and converted into the currency of the Republic of Serbia – dinars.

For informational price displays in other currencies, the middle exchange rate of the National Bank of Serbia is used.

The amount charged to your credit card will be expressed in your local currency through conversion according to the rate used by the card organizations, which we cannot know at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price displayed on our website. Thank you for your understanding.

Refunds

In the case of returning goods and refunding a buyer who previously paid with a credit card, either partially or in full, regardless of the reason for the return, Try Hello Smile is obliged to refund exclusively through VISA, EC/MC, and Maestro payment methods, which means that the bank will refund the amount to the cardholder’s account upon the seller’s request.

Delivery of Goods

The ordered goods will be packed in a way that prevents damage during usual handling in transport.

All orders are delivered to the Buyer by a courier engaged by “SMILEON TEETH” DOO and "Hello Smile DOO".

The buyer is responsible for checking the correctness of the order. The buyer must immediately inspect the delivered goods upon receipt and notify the courier of any defects immediately.

The buyer must check for any damages upon delivery and report them to the delivery worker who delivered the goods and refuse to accept the damaged goods. If the buyer notices any damages later and has not returned the goods to the courier, the buyer can contact us via email at info@tryhellosmile.com to arrange for the goods to be returned.

If the buyer refuses the incorrectly delivered items, the courier must determine how the error occurred by consulting the buyer and calling the customer center of SMILEON TEETH DOO and Hello Smile DOO. “SMILEON TEETH” DOO and Hello Smile DOO reserve the right to refuse delivery of ordered goods if they determine a violation of these terms and conditions advertised on the website.

If the buyer made an error while ordering, the delivery cost is borne by the buyer, and the goods are returned to the Try Hello Smile Shop. The buyer bears the costs of returning and exchanging purchased goods, except when the buyer receives a defective or incorrect item, in which case the shipping costs are covered by Try Hello Smile Shop.

“SMILEON TEETH” DOO and "Hello Smile DOO" are not responsible for the delivery service’s performance or quality.

The courier is obliged to deliver the order professionally and responsibly in accordance with the service rules and the General Terms of e-commerce business of Try Hello Smile Shop.

In case of delays in delivery due to vehicle breakdowns or other objective or subjective reasons on the courier's side, the delivery cost is borne by the courier.

A buyer can create multiple orders in a single day.

If the Buyer requires a specific delivery time (e.g., a birthday or another event that starts at a specific time), please indicate this in the notes so we can accommodate your request.

The consumer, in the capacity of the buyer, concludes the sales contract with HELLO SMILE d.o.o., Požeška 14, Osijek, OIB: 83499350155 (hereinafter: the Seller) as the seller.
Legal entities as buyers are subject to the application of the Obligations Act and the Electronic Commerce Act, and the Consumer Protection Act does not apply to them.
For legal entities as buyers, the sections of these Terms of Use concerning material defects of the Product, complaints, and the right to unilateral termination do not apply. In these cases, the relevant provisions of the Obligations Act and the Electronic Commerce Act shall apply. The Seller may, at its discretion, grant the legal entity the same rights as those granted to the consumer in each specific case.
The conclusion of the sales contract via the website www.tryhellosmile.com is regulated in accordance with legal provisions, particularly considering the principles and provisions of the European Union directives and regulations. The conclusion of the contract via the website www.tryhellosmile.com represents the conclusion of a distance contract.

These Terms of Use also represent a pre-contractual notice as regulated by the Consumer Protection Act.
Means of remote communication include all means that can be used to conclude a distance contract without the simultaneous physical presence of the trader and the consumer, such as the internet and electronic mail.
